In comparison to the former piece of legislation (Regulation 838/90), the new Regulation 278/05 specifies more stringent requirements forin four main areas:

1. INSPECTION OF BUILDINGS FOR ACM by:

Redefining asbestos-containing material (ACM) to include all
materials containing 0.5% or more asbestos instead of the
former 1% asbestos,

Extending applicability of the Regulation to include all
materials containing asbestos, both friable and non-friable,

Increasing responsibility of the owner of a building, constructor
or employer for carrying out an inspection (an
asbestos survey)
and providing an inspection report to all who may be affected
by asbestos in the material,

Specifying minimum number of samples of the material
collected during the inspection for the purpose of determining
whether the material contains asbestos,

Providing reference standard for analysis of bulk material
samples.

2. PROCEDURAL REQUIREMENTS FOR ASBESTOS-REMOVAL
WORK by:

Increasing requirements for dust control during asbestos
removal work,

Specifying more stringent procedures for glove bag
application,

Specifying more stringent requirements for respiratory
protective equipment to be used in Type 1, Type 2 and
Type 3 operations.

3. AIR TESTING by:

Introducing clearance air testing which must be conducted
upon completion of Type 3 asbestos removal work,

Providing standard for acceptable airborne fibre concentration,

Providing a reference standard for analysis of air samples.

4. TRAINING OF WORKERS ENGAGING IN ASBESTOS-RELATED
WORK by:

Increasing training requirements for all workers involved in
asbestos removal work.
